In the resolution of domestic and international commercial disputes we act as counsel in arbitration, mediation and settlement, and we assess the appropriate path in light of the commercial background of the dispute and the client’s legal needs. The contract between the parties, the applicable procedural rules and the features of the commercial relationship are examined together so that the legal approach can be set from preparation through conclusion.
Experience in arbitration and dispute work informs our work from the drafting of dispute-resolution clauses at the contract stage through the proceedings and the enforcement of awards. We treat pleadings, document production, witness and expert evidence and hearing preparation as connected steps; in mediation and settlement we attach importance to the clarity and workability of the terms and to the correct arrangement of the parties’ continuing obligations.
